Members of the RGA (Online Gambling Association) operating internationally as gambling companies file an appeal with the Athens Administrative Court of Appeal for failing to answer in their application for gambling rights in Greece.
Companies claim that while they filed an application in July of 2013 with the Greek State (Ministry of Finance) and the Greek Committee for Supervision and Game Control (EEPC), they received a reply only from the second that it is not competent to examine the applications! The Ministry never answered. After that, the companies, which say they are Betfair and William Hill, have appealed to the Greek courts against the response to the EERP and the inertia of the Ministry of Finance.
The Greek government has repeatedly failed to implement the laws it has set itself to open up the online gambling market. While the law (4002 / 2011) permits this licensing, it has never been applied for more than two years. Instead, there is a transitional regime with a closed number of operators, which RGA has previously turned against the manifest illegality of the Ministerial Decision by submitting a separate request for cancellation on the grounds that it is contrary to the fundamental freedom of establishment and the freedom to provide services. guaranteed by articles 49 and 56 of the Treaty on the Functioning of the EU. (TFEU) and the 5 (1) article of the Greek Constitution, which protects the freedom to conduct an economic activity.
